Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in section 95(1) points 1–5 of the Public Procurement Act apply to it. These include, among other things, convictions for criminal offences, violations of rules on employing foreign nationals, offences related to child labour or human trafficking, tax, fee or environmental charge arrears, and breaches of sanctions. If any of these grounds apply, the contracting authority will exclude the bidder from the procedure.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or another similar register in its country of establishment, if required by that country’s law. For bidders registered in Estonia, the contracting authority checks the data itself; a foreign bidder must submit a copy of a valid registration certificate. The bidder and/or its subcontractor must have completed at least 1 similar contract within the 5 years before the start of the procurement; the subject of the procurement is reinforcement and concreting of foundations. A list of the most important contracts completed during the last five years must be submitted, including their value, dates and the other contracting parties. The bidder and/or its subcontractor must have qualified responsible personnel for carrying out the works, including a construction manager holding the professional certificate “Construction site manager, level 5” or an equivalent/higher qualification. Copies of documents proving the qualifications and competence of the responsible persons must be submitted; a foreign bidder must submit the corresponding documents from its country of establishment and a confirmation that within one month after signing the contract it will submit the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the above-mentioned responsible person’s qualification and competence. The bid must comply with the procurement documents, and the bid price must be submitted according to the structure set out in the worksheet “Award criteria and evaluated indicators” and also in the form “Calculation”.
