Compliance requirements
The bidder and its representatives must not have been convicted of participation in a criminal organisation, breach of duty of integrity, corruption, fraud, a terrorist offence or other terrorism-related offence, money laundering, or financing of terrorism. There must also be no conviction for enabling illegal employment of a foreign national or violating the conditions for employment of a foreign national in Estonia, or for illegal use of child labour or human trafficking. The bidder must not have outstanding tax, fee or environmental charge debts, nor tax or social security contribution debts under the law of its country of establishment. The contract must also not be awarded if it would violate an international sanction or a sanction of the Government of the Republic. The bidder must confirm that none of these exclusion grounds apply to it.
Qualification criteria and exclusion grounds
The bidder must have properly performed, within the last 60 months, at least one contract similar to the subject of the tender, under which railway construction and/or major repair works were carried out on station and/or interstation track sections for a total length of at least 400 metres. A list of such reference contracts must be submitted, including the scope of works, dates and the other contracting parties; if a reference contract was awarded through public procurement, the public procurement reference number must also be provided. The bidder must also confirm that the submitted reference contract(s) were performed properly. The bidder’s site manager must hold a qualification in line with the professional standard “Railway track mechanic”, at least level 4, and a copy of the certificate must be submitted with the bid documents. The bidder’s workers, at least 2 persons, must hold a qualification in line with the professional standard “Assistant railway track mechanic”, at least level 2, and copies of their certificates must also be submitted with the bid. In addition, the bidder must submit a list of the equipment to be used in contract performance, with the main parameters, and a description of the technological process of the works. If the bidder wants to receive extra points for an environmental management system, it must submit a copy of a valid ISO 14001 or equivalent certificate, or a confirmation from an independent audit firm or accredited certifier; if such a system is not implemented, an appropriate confirmation must be provided. The bid price form must be completed and submitted with the bid. The machine-readable notice did not include precise compliance and form requirements; these must be checked in the tender documents.
