Compliance requirements
The bidder must confirm that neither the bidder nor its management, representation or supervisory body members have been finally convicted within the last five years of participation in a criminal organisation, corruption, money laundering or terrorist financing, use of child labour or other forms of human trafficking, participation in a criminal organisation, or committing a terrorist act or offences related to terrorist activity, or that any current exclusion period no longer applies. If an exclusion ground exists, the bidder may submit a description of self-cleaning measures and evidence of restored reliability where permitted. The machine-readable notice did not include more precise exclusion grounds; these must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have carried out at least 1 similar works contract or design-and-build contract within the last 60 months before the start of the procurement. A similar contract is one involving the construction of a sports field, playground or other sports or leisure facility. The work must have been properly completed and accepted by the client; the warranty period may still be running. The bidder must submit a list of such works and the required details and evidence.
The bidder’s average net turnover for the last three financial years completed by the start of the procurement must be at least EUR 55,000. If the financial year is not the calendar year, data must be provided for the relevant financial years within the period 01/01/2023–31/12/2025.
The bidder must be registered in the commercial register of its country of establishment, and the contracting authority may require proof of registration. Under the compliance conditions, the bidder must confirm that the bid complies with the procurement documents, that a joint bid includes a power of attorney where applicable, that the bid is unconditional, that any trade secret is justified, that equivalence has been explained and supporting evidence attached, and that the offered goods are not subject to international sanctions. If the procurement documents contain more precise requirements, they must be checked in the tender documents.
