Compliance requirements
The bidder must be excluded from the procurement procedure if any of the exclusion grounds listed in Section 95(1)(1)–(5) of the Public Procurement Act apply to it or its representative: participation in a criminal organisation, breach of integrity duties or a corrupt act, fraud, a terrorist offence or other terrorist activity-related offence, money laundering or financing of terrorism; enabling work for a foreign national staying in the country without a legal basis or violating the conditions for a foreign national’s work in Estonia, including paying less than the statutory wage; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax or social security contribution arrears; or a breach of an international sanction or a Government of the Republic sanction. The bidder must confirm that none of these exclusion grounds apply to it.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, if required by the laws of that country; an Estonian bidder does not need to submit a register extract. The bidder and/or its subcontractor must have completed at least one or more contracts within the 60 months before the start of the procurement that involved construction or repair works on roads, streets or squares, with a total value of at least EUR 40,000. A list of the main contracts completed during the last 60 months must be submitted, including their value, dates and the other contracting parties. The works must be supervised by a qualified responsible person, including a road construction manager with the qualification “Road Engineer, level 6” or equivalent or better. A foreign bidder must submit copies of the relevant qualification and competence documents issued under the laws of its country of establishment, and a confirmation that within one month after signing the contract it will submit the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the above-mentioned responsible person’s qualification and competence.
