Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, as well as any other exclusion grounds set out in the ESPD and procurement documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The exact exclusion grounds and any proof requirements must be checked in the procurement documents.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register or an equivalent register in its country of establishment. A bidder resident in Estonia must be registered in the Estonian Commercial Register.
The bidder’s net turnover for each of the last three completed financial years before the start of the procurement must be at least EUR 450,000 per year. Joint bidders may aggregate turnover. The successful bidder must submit an extract from the reports for the last three completed financial years showing the net turnover. This requirement may not apply to an Estonian legal entity if the data are publicly and freely available.
For a construction contract, the bidder must have an MTR registration or an equivalent registration in its country of establishment for the activity of construction, including general construction and internal or associated water supply or sewerage systems. Registration is also required for electrical work, including design and construction/installation of electrical installations, and for design of internal or associated water supply or sewerage systems.
The bid must comply with the procurement documents, and where necessary equivalence must be explained and supporting evidence provided. If the bidder relies on equivalence, it must justify this sufficiently.
