Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, breach of duty of integrity, corruption, fraud, a terrorist offence or other terrorism-related offence, incitement, aiding or attempt thereof, money laundering or financing of terrorism. A bidder is also excluded if it has been convicted of enabling the employment of a foreign national staying in the country without legal basis or of violating the conditions for employing a foreign national in Estonia, including paying wages below the statutory wage rate, or of illegal use of child labour or human trafficking. Exclusion also applies where the bidder has tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment, and where entering into the contract would breach an international sanction or a sanction of the Government of the Republic. The bidder must submit a confirmation that no exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must prove its ability to perform the contract in at least one of two ways: either it has the necessary free financial resources of at least EUR 150,000 for contract performance, or its equity as of 30 April 2026 is at least 25% of the balance sheet total, but not less than EUR 150,000. In the first case, a bank statement confirming the available free funds must be submitted. In the second case, a free-form statement together with a balance sheet signed by the bidder’s legal representative as of 30 April 2026 must be submitted.
The tender must name the bidder’s authorised representative, who communicates with the contracting authority and provides clarifications if needed, and the responsible representative during contract performance, i.e. the contractor’s project manager. Contact details for the representatives must be provided in the required form.
The bidder must have, within the previous 240 months, experience in constructing at least one De 225 pressure pipeline section of at least 150 metres. The proof must state the client’s details, the location of the project, the time of execution, and confirmation that the works were carried out properly and in accordance with good construction practice. If the bidder relies on a subcontractor’s references, the tender must show that the person with the relevant experience will personally perform that part of the contract.
To confirm compliance, the bidder must confirm that the tender complies with the conditions set out in the procurement documents. Conditional tenders are not permitted. The price form must also be submitted as a required document.
