Compliance requirements

The mandatory exclusion grounds concern participation in a criminal organisation, corruption, fraud, terrorist offences or other terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreigners, illegal use of child labour or human trafficking, and tax, fee, environmental charge or social security contribution arrears. The bidder must confirm that none of these grounds apply. The voluntary exclusion grounds cover serious or repeated breach of an earlier public contract and the submission of false information about compliance with selection criteria or failure to submit requested additional documents. The bidder must also confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that the materials, equipment and goods used in the works, including components, are not produced in or originate from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin for this purpose.

Qualification criteria and exclusion grounds

During the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, at least one of them with a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. Upon request by the contracting authority, evidence of proper performance of the similar electrical construction contracts must be provided, unless the contracting authority can obtain the information itself from public or its own databases without significant cost. In addition, the bidder must have a person in charge of electrical works with valid A-competence or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, who has a relevant certificate at the time of submission of tenders and who has been entered into the EPP environment before the opening of tenders. The bidder must also have an employee with valid switching rights for switching operations related to the works and a person appointed as responsible for the work operation with valid rights; both must be entered into the EPP environment before the opening of tenders. The bid must include the names, job titles and contact details of the signatory or signatories and the contact person for matters related to contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. The tender must include the price table in the prescribed form and all unit price fields must be completed. The tender must comply with all conditions set out in the procurement documents, and alternative or conditional tenders are not allowed.
