Compliance requirements

Mandatory exclusion grounds relate to convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, enabling illegal employment of a foreign national, illegal use of child labour and human trafficking, as well as tax, fee or environmental charge arrears. The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies or authorised representatives have been convicted for such offences and that there are no tax debts. Optional exclusion grounds concern serious or repeated breach of a previous public contract and the submission of false information about compliance with selection criteria or failure to submit requested documents. The bidder must also confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that the materials, equipment and goods used in the works are not produced in or originating from Russia or Belarus; the contracting authority may request certificates of origin for this purpose.

Qualification criteria and exclusion grounds

During the 60 months before the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. The contracting authority may request evidence that the similar electrical construction contracts were properly performed if it cannot obtain the information from public or its own databases without major expense. For compliance, the bid must include a completed price table. The bidder must have a person managing electrical works with a valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Qualifications Act; this person must hold the relevant certificate at the time of bid submission and must be entered in the EPP environment before bid opening. The bidder must also have a worker with valid switching rights for work-related switching in the 0.22–20 kV electricity network; for low-voltage works at least low-voltage switching rights are required, and in other cases both low-voltage and medium-voltage switching rights are required. In addition, the bidder must have a person designated as responsible for the work operation, who must be entered in the EPP environment before bid opening. The bidder must provide the names, job titles and contact details of the contract signatory(ies) and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included.
