Compliance requirements
The bidder confirms that no exclusion grounds under Section 95 of the Public Procurement Act apply. Examples mentioned include tax debt or failure to fulfil tax obligations, a final court judgment for an occupational or economic offence, a serious breach in a previous procurement including material non-performance of a contract, and a conflict of interest or an anti-competitive agreement. For Estonian bidders, the contracting authority checks the absence of tax debt from public registers itself; for foreign bidders, a tax authority certificate or the ESPD form may be requested before contract award/contract conclusion.
Qualification criteria and exclusion grounds
The bidder must have, within the 36 months before the start of the procurement procedure, experience from at least one properly performed contract whose subject was the supply of a plastic injection moulding machine or other equivalent production equipment comparable to the procurement object, together with at least installation and commissioning or training. Equivalent experience means that, in addition to delivery of the equipment, at least installation and commissioning or user training was provided. The bidder must submit an additional document to prove the previous experience, such as a contract extract, handover-acceptance report, reference letter or other equivalent document. If the bidder does not meet the conditions, this must be checked in the tender documents.
