Compliance requirements
The bidder must confirm that none of the exclusion grounds under § 95(1) and § 95(4) of the Public Procurement Act apply. This means, among other things, that neither the bidder nor its authorised representatives may have convictions for corruption, fraud, terrorism, money laundering, illegal use of child labour or human trafficking offences; the bidder must not have tax debts; and the contract must not breach international sanctions or sanctions imposed by the Government. The same checks also apply to any entity whose resources the bidder relies on for qualification, and to the successful bidder and, where relevant, all joint bidders.
For subcontractors in the first tier during contract performance, the same exclusion grounds are checked, and they must also submit a tender passport if required by the tender documents. The notice does not provide any additional exclusion grounds beyond these points; the official tender documents should be checked for the full wording and any further confirmations required.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment. The bidder’s net turnover for each of the last three completed financial years before the start of the procurement must be at least EUR 800,000 per year. The bidder must provide the turnover figures for the last three completed financial years in the tender passport and be ready to submit supporting documents if the data are not publicly available or if the bidder is foreign.
The bidder or the joint bidders as a whole must have at least 2 references from the last 60 months before the procurement started for similar heated non-residential design-and-build or reconstruction works as main contractor, each for a building, building part or building complex with at least 500 m² of enclosed net floor area. Similar works include production, commercial, welfare, accommodation, entertainment, educational, research, healthcare and sports buildings. The references must show that the bidder acted as main contractor and that the works included construction or reconstruction of external and internal structures, a new or reconstructed electrical system, water and sewerage system, heating/ventilation/cooling system, and low-current systems. The bidder must list the contracts in the tender passport and, if requested, provide the client’s confirmation that the works were performed properly.
