The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–5 of the Public Procurement Act apply to it. These include, among other things, convictions for certain crimes, illegal employment-related violations involving foreign nationals, child labour or human trafficking offences, tax debts, and breaches of sanctions. The bidder must be registered in the commercial register or another similar register in its country of establishment, if this is required by the laws of that country. For bidders established in Estonia, the contracting authority will check the data itself. A foreign bidder must confirm registration in the commercial register or another similar register if that is mandatory under the laws of its country of establishment.
