Compliance requirements
The bidder must confirm that neither it nor its management, representation or supervisory body members have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing, child labour or other forms of trafficking in human beings. If any such ground applies, the bidder may submit evidence of self-cleaning measures where permitted. Subcontractor checks apply at the contract performance stage and concern first-tier subcontractors.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, or provide evidence of registration if requested by the contracting authority. For technical and professional capacity, the bidder must have properly performed at least one similar works contract as the main contractor within the last 60 months. That contract had to have a value of at least EUR 85,000 excluding VAT, and it had to include repair of pavement cracks using bitumen emulsion with impregnated crushed stone in a volume of at least 20 tonnes. A list of completed contracts must be submitted, including dates, client contact details and public procurement reference numbers where available. The ESPD also requires information on the education and professional qualifications of managers or persons responsible for managing the works, where such qualifications are necessary. The bid must be submitted in the form required by the procurement documents, and conditional bids are not allowed. If the bid relies on equivalence, this must be explained and supporting evidence must be attached where necessary.
