The bidder must confirm that none of the mandatory exclusion grounds apply: conviction for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; conviction for enabling the employment of a foreign national staying in the country illegally or for violating the conditions of employment of a foreign national; conviction for illegal use of child labour or human trafficking; and tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of the bidder’s country of establishment. The bidder must also confirm that none of the optional exclusion grounds apply, including serious or repeated breach of a previous contract or submission of false information about qualification. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus.

The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, of which at least one must have a value of at least EUR 40,000 excluding VAT. The bidder must provide a list of the contracts, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, reference numbers. Upon request by the contracting authority, evidence of proper performance of the similar electrical construction contracts must be submitted, unless the authority can obtain the information easily from public or its own databases.
