Compliance requirements
The bidder must not have the exclusion grounds listed in § 95(1) points 1–5 and § 95(4) point 12 of the Public Procurement Act. The bidder must confirm the absence of these grounds in the public procurement register. If the bidder, a joint bidder, a relied-on person or a foreign branch has other persons who may represent the company, make decisions on its behalf or control it and who are not visible on the commercial register card, the bidder must provide the name and personal identification code of such authorised persons, or confirm that no such persons exist. If the tender is submitted by a foreign company or includes a foreign subcontractor, the bidder must add documents to the tender under “Additional documents” proving the absence of the exclusion grounds listed in § 95(1) points 1–5 and § 95(4) point 12, including documents concerning the company itself, its management, governing or supervisory body members, procurist and other persons entitled to represent, control or make decisions on behalf of the company.
Qualification criteria and exclusion grounds
The bidder’s total net turnover from all business activities in each of the last three completed financial years must be at least EUR 3,000,000 per year. If the bidder relies on another company’s resources to meet the turnover requirement, the other company must give consent stating how much turnover support it allows, that it will provide financial resources if needed during contract performance, and that it is jointly liable for performance of the contract. If joint bidders rely on each other’s resources, the tender must also state the share and nature of the contract part performed by each joint bidder. The bidder must involve qualified design specialists for the project design: a structural engineer with at least level 7 professional qualification or equivalent; heating, ventilation, cooling, water supply and sewerage engineers with the required level 7 qualifications or equivalent; an electrical, low-voltage and automation engineer with the required qualifications or equivalent; a fire safety expert with at least level 6 qualification or equivalent; a BIM coordinator with higher education in construction or architecture; and a road engineer with at least level 7 qualification or equivalent. The bidder must confirm that these specialists will be involved in performance of the contract and submitted for approval before design work starts. The tender must be signed by the bidder’s legal representative, or by an authorised person if a power of attorney is attached. The bidder must also complete the buyer’s “Tender price table” form. The machine-readable notice did not include any more precise requirements; they must be checked in the official tender documents.
