Purchase of railway rails

The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–5 of the Estonian Public Procurement Act apply to it: convictions related to criminal organisations, corruption, fraud, money laundering or terrorist financing, offences related to illegal employment of foreign workers, child labour or human trafficking, tax or social security debts, or breaches of international or Government sanctions. It must also be confirmed whether the company is restricted by the contracting authority from submitting a tender or request to participate based on its place of residence or establishment. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents officially published for the procurement documents or tender documents.

The bidder must be registered in the commercial register or another equivalent register in its country of establishment, if required by the laws of that country. For bidders registered in Estonia, the contracting authority will check the data itself. A foreign bidder must confirm that it is entered in its home country’s commercial register or an equivalent register. The bidder or the manufacturer represented by the bidder must have produced and marketed similar railway rails, turnouts and turnout components for the last three years. To prove this, the bidder must submit a list of the most important railway rail, turnout and turnout component supply contracts carried out during the last three financial years, including quantities and customers.
