Compliance requirements
The contracting authority will not award the contract and will exclude a bidder if any of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply: participation in a criminal organisation, corruption, fraud, terrorist offences or money laundering, enabling illegal employment or violating the conditions for the employment of a foreign national, illegal use of child labour or trafficking in human beings, tax, fee or environmental charge arrears, social security contribution arrears, or a breach of an international sanction or a sanction of the Government of the Republic. The bidder must confirm that none of these grounds apply to it.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or an equivalent register in its country of establishment, if required by the laws of that country. For Estonian bidders, the contracting authority will check the data itself.
The bidder and/or its subcontractor must have completed at least 1 contract similar to the subject of the tender within the last 60 months before the start of the procurement, with a total value of at least EUR 20,000. Similar work means renovation work in industrial premises. The bidder must submit a list of the most important contracts completed within the last 60 months, including their value, dates and the other contracting parties, using form “Contract list 1”.
The bidder and/or its subcontractor must have completed at least one contract for design and installation work related to electrical equipment within the last 60 months before the start of the procurement, with a total value of at least EUR 10,000. The contracts must have been performed properly. The bidder must submit a list of the most important contracts completed within the last 60 months, including their value, dates and the other contracting parties, using form “Contract list 2”.
The bidder and/or its subcontractor must have qualified responsible persons for carrying out the works, including: a person managing construction works with the professional certificate “Construction engineer, level 6” or equivalent; a designer with at least the professional qualification Electrical engineer, level 6, specialising in building electrical installations and competent in designing building electrical installations and/or a class B competence certificate with design rights or equivalent; and a person managing electrical works with at least a class B competence certificate or equivalent. The bidder must submit copies of documents proving the qualifications and competence of the responsible person(s). A foreign bidder that does not have such documents issued under Estonian regulations must submit copies of the qualification and competence documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the above-mentioned responsible person’s qualification and competence. The bidder must also submit form “List of responsible persons”.
