Compliance requirements
The contracting authority will exclude a bidder if any mandatory exclusion ground applies, for example convictions related to organised crime, corruption, money laundering, terrorist financing, illegal employment, child labour or trafficking in human beings, tax debts, or international sanctions. The bidder must also confirm that no voluntary exclusion grounds apply, such as breaches of environmental, social or labour law obligations, bankruptcy or liquidation, serious professional misconduct, anti-competitive agreements, conflicts of interest, material breach of previous contracts, false statements, attempts to influence the contracting authority, or tax offences. The bidder must also confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 150,000. If the financial year does not coincide with the calendar year, the requirement applies to the last three completed financial years, and at least six months must have passed since the end of the last completed financial year by the bid submission date. The bidder must provide extracts from the financial statements for the last three completed financial years or other proof of turnover if the data are not publicly available to the contracting authority from a register. During the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for similar electrical construction works, at least one of which must have had a value of at least EUR 80,000 excluding VAT; a list of contracts must be provided with performance periods, client contact details and public procurement reference numbers, together with evidence of proper performance if requested. To submit a bid, the bidder must have a worker with valid switching rights, a person appointed as responsible for work operations, and an electrical works manager with valid A-competence or at least level 6 qualification who is entered in the EPP environment before bid opening. The bid must also include the price table, representation details and, where necessary, a power of attorney. If the bidder relies on another company’s economic and financial standing, a digitally signed confirmation or certificate from that company must be provided, and the bidder and the relied-on company are jointly liable for performance of the part of the contract for which the other company’s resources are used.
