Compliance requirements
Tenderers originating from third countries are excluded from the procedure. Third countries are countries that are not EU member states, EEA agreement countries, WTO GPA countries, or countries with which the European Union has not concluded a reciprocal free trade agreement including public procurement provisions. The tenderer must state its country of origin, meaning the country where the company is registered.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification, suitability or compliance requirements. These must be checked in the official tender documents. The tender documents indicate that the tenderer must complete Annex 1 (Technical Requirements) and submit a comprehensive price offer or bill of quantities, and that the tender price must be structured according to the “Evaluation Criteria and Evaluated Indicators” worksheet. If the tender is a joint tender, an authorised representative must be appointed and a power of attorney for the joint tenderers must be attached. The tenderer must also confirm acceptance of the contractual penalty terms, the equivalence rules, and the funding-related validity requirement that the tender remains valid for at least 3 months from the tender submission deadline.
