Compliance requirements
The bidder must confirm the mandatory exclusion grounds in the tender documents, including convictions for participation in a criminal organisation, corruption, fraud, terrorist offences and related crimes, as well as any other exclusion grounds set out in the ESPD/tender documents. If an exclusion ground applies, the bidder may need to provide evidence of self-cleaning where allowed. The machine-readable notice does not include the full list of exclusion grounds; the exact details must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must have, for the whole contract period, an owner’s supervision specialist with at least the professional qualification "Diplomeeritud hüdrotehnikainsener, tase 7" with the additional competence "Omanikujärelevalve", or an equivalent or higher qualification. If an equivalent foreign qualification is used, a copy of the licence/certificate or proof of the right to work in that field under the laws of the country of establishment must be provided. The bidder must submit the data of the required person and the professional certificate number. The bidder may rely on another party’s resources if it proves that those resources are available and that the other party agrees to their use in performing the contract. The tender documents also require confirmation that the bid complies with the tender documents, that any equivalence has been explained and supporting evidence added, and that the bidder is not the same construction contractor as the supervised structure and is not linked to the persons whose activities it supervises. For joint bids, a joint-authorisation document must be attached.
