Compliance requirements

The contracting authority will exclude a bidder if any of the exclusion grounds under § 95(1) points 1–5 of the Public Procurement Act apply: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or financing of terrorism; enabling work by a foreign national staying in the country unlawfully or violating the conditions for a foreign national’s work; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax or social security contribution arrears in the bidder’s country of establishment; and breach of an international sanction or a sanction of the Government of the Republic. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

The bidder must have at least one properly performed contract for works of similar complexity and scope to the subject of the tender, completed within the 60 months preceding the start of the procurement. A list of the main contracts must be submitted, including their value, dates and the other contracting parties. The bidder and/or its subcontractor must have a qualified person responsible for the works: a construction manager with professional qualification as a civil engineer at least level 6 (excluding the initial qualification) with competence in managing construction activities, or a construction manager at least level 5, or an equivalent qualification. A copy of the document proving that person’s qualification and competence must be submitted. The bid must comply with the tender documents, conditional bids are not allowed, and if an equivalent solution is used for a standard or other requirement, equivalence must be explained and evidence must be attached. The bidder must also confirm that the offered goods are not the object of international sanctions and do not originate from sanctioned areas.
