Compliance requirements
Mandatory exclusion grounds: the bidder and its management, supervisory or authorised representatives must not have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, financing of terrorism, unlawful employment of a foreign national, illegal use of child labour, or human trafficking. The bidder must not have tax, fee or environmental charge arrears, or social security contribution arrears under the law of its country of establishment. Voluntary exclusion grounds: the contracting authority may exclude a bidder that has seriously or repeatedly breached an essential term of a previous public contract, or that has provided false information about qualification or failed to submit required information or documents. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for similar electrical construction works, at least one of which must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting party’s details and, in public procurement cases, the reference numbers. The contracting authority may request evidence of proper performance. The tender must comply with the procurement documents and include the price table, with all unit price fields completed. The bidder must have a person in charge of electrical works with valid A-level competence or at least level 6 qualification under the Vocational Education Institutions Act, with the relevant certificate and entered into Elektrilevi’s partner portal before bid opening. The bidder must also have a switching-authorised employee for 0.22–20 kV network works and a person responsible for the work operation, both entered into the partner portal before bid opening. The bidder must provide the names and contact details of the contract signatory(ies) and the contact person, and a power of attorney if authority does not arise from the articles of association. If the bidder chooses the contracting authority’s factoring programme instead of the standard payment term, a 95-calendar-day payment term applies. The bidder must also confirm that the materials, equipment and goods used in the works are not produced in or originating from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin.
