Compliance requirements
The bidder must confirm that none of the exclusion grounds set out in subsections 1 and 4 of Section 95 of the Public Procurement Act apply. A national restriction based on the bidder’s place of residence or establishment is also addressed; if relevant, the bidder must answer it in the manner set out in the procurement documents. The exact exclusion grounds and confirmations must be checked in the procurement documents.
Qualification criteria and exclusion grounds
The bidder’s average turnover in the construction works sector over the last three financial years must be at least EUR 1,000,000 per year. The bidder must have at least one new-build construction project carried out as a main contractor within the last 60 months, with a value of at least EUR 500,000 excluding VAT, and a use permit must have been issued for it. The bidder must confirm that it pays all taxes and contributions required by law on employees’ wages. The bidder must also have sufficient labour resources to perform the contract: the average number of employees over the last 12 months must be at least 10, and a certificate from the Tax and Customs Board or another document showing the number of employees must be submitted. The bid must be submitted according to the structure set out in the procurement documents, and the bidder must confirm that it has reviewed the site, the project and the essential terms of the contract and has taken into account all costs necessary for performing the works. If any specific proof or form is required, it must be submitted in the form described in the procurement documents.
