Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The ESPD also includes a question on payment of taxes and social security contributions, and the bidder must provide proof or allow the contracting authority to verify the information if necessary.
Qualification criteria and exclusion grounds
The bidder must submit a technically compliant offer in the Excel format required in Annex 1. Annex 1 must state the medicinal product’s active substance, original name, dosage form, strength of the offered dose, manufacturer, unit price and total price. The offer price must be stated in euros excluding VAT and must include all costs for delivery and unloading to the pharmacy of Tartu University Hospital at L. Puusepa 8, Tartu. The bidder must submit the application for participation in the procurement in Annex 3, Form II. The offered medicinal product must have a valid marketing authorisation in Estonia; if it does not, the contracting authority will check the situation through the Medicines Agency register and may request import of the medicine if needed. The bidder must hold a valid wholesale distribution licence for medicinal products in Estonia. The offer must comply with the procurement documents, and where equivalence is used it must be explained and supported by evidence. The bidder must also confirm that the offered goods are not subject to international sanctions and that subcontractors or suppliers linked to the Russian Federation will not be involved for more than 10% of the contract value.
