Compliance requirements
The bidder must confirm that neither it nor the members of its management or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The exact exclusion grounds must be checked in the ESPD and the tender documents.
Qualification criteria and exclusion grounds
The bidder must be entered in the Estonian commercial register or in an equivalent register in its country of establishment, if required there. If requested by the contracting authority, a register extract with an Estonian translation must be provided. The bidder’s net turnover for each of the last three financial years completed by the start of the relevant procurement must be at least EUR 220,000 per year. The bidder must also provide the required confirmations and documents, including confirmation that the bid complies with the tender documents, a power of attorney if the bid is submitted by an authorised representative, a list of the bidder’s representatives for exclusion checks, confirmation that the bidder is the bus manufacturer or has the manufacturer’s authorisation to market the buses in Estonia, and a detailed price table in the prescribed form. Under the compliance requirements, the bidder must also confirm that it will not use subcontractors or suppliers accounting for more than 10% of the contract value if they are linked to a citizen, resident or entity established in the Russian Federation or are controlled by such persons or entities. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned territories. If the input does not give an exact number or exact form for any requirement, it must be checked in the tender documents.
