Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, child labour or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may in some cases submit evidence of self-cleaning to restore reliability. The contracting authority also asks for details of authorised persons if they are not visible in the business register, and the bidder must confirm that it does not use subcontractors or suppliers linked to the Russian Federation for more than 10% of the contract value. The exact exclusion grounds and any exceptions must be checked in the ESPD and the tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last completed financial year must be at least EUR 300,000. Joint bidders may aggregate their turnover. If the bidder relies on the capacities of another entity, it must also provide that entity’s details and, where required, its consent and supporting evidence. For technical capacity, the bidder must have performed at least one sale contract for a controller-based monitoring and control system within the last 60 months. The contracting authority may request a buyer’s confirmation of the contract’s subject matter, completion date and value. The bid must include the manufacturer’s technical specification or other manufacturer document for the distribution cabinet controller, and the manufacturer’s technical specification or other manufacturer document for the control software, proving compliance with the technical description. The bid must comply with the procurement documents, and any equivalence must be explained with supporting evidence. In the price breakdown table, all item prices must be completed in euros to two decimal places, excluding VAT.
