Compliance requirements

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurists or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the tender passport. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The contract notice and tender passport may also require the relevant confirmations and electronically available evidence.

Qualification criteria and exclusion grounds

The bidder must prove prior sales experience with the offered or equivalent products: during the last 3 years, it must have sold at least one third of the expected quantity stated by the contracting authority in Annex 4. To prove this, the bidder must provide a list of properly performed sales contracts or transactions, including the exact product name, contract date, quantity sold under each contract, and the other party’s details. The bidder must also confirm in the tender passport the name of a product representative; this person must have been trained by the manufacturer or its authorised representative. Copies of certificates must be submitted upon the contracting authority’s request. In addition, the bidder must confirm that the tender complies with the procurement documents, that the offered goods are not subject to prohibited sanctions, and that in the case of a joint tender the power of attorney and joint liability confirmation have been submitted. If the machine-readable notice does not contain a precise requirement, it must be checked in the tender documents.
