Compliance requirements
The bidder must be excluded if it has tax debt, environmental charge debt, or debt for tax or social security contributions under the law of its country of establishment. Before exclusion, the contracting authority must give at least 3 working days to pay or defer the debt. The bidder must also be excluded if concluding the contract with it would breach an international sanction or a sanction of the Government of the Republic. In addition, the procurement documents set a restriction that only economic operators established in Estonia, another EU Member State, an EEA Agreement country, or a country that has acceded to the WTO Government Procurement Agreement may submit a tender. The bidder must confirm this.
Qualification criteria and exclusion grounds
The bidder must have properly performed at least one fencing installation contract within the 60 months before the start of the procurement, with a total value of at least EUR 10,000 excluding VAT. For the reference, the bidder must provide the contract partner, the main subject of the contract and the time of performance, and, if requested, evidence that the reference contract was properly performed. The tender must remain valid for at least 2 months from the tender submission deadline. The bidder must confirm that the goods offered are not subject to international sanctions and do not originate from areas under sanctions. The bidder must also submit the detailed price list on the form provided by the contracting authority, complete all yellow-marked fields and not alter the structure of the table. By submitting the tender, the bidder must confirm compliance with the tender documents and, where relevant, explain equivalence and attach evidence of equivalence. If the bidder marks any trade secret, it must briefly describe and justify it; if there is no trade secret, this must also be stated.
