Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under § 95(1) points 1–5 of the Estonian Public Procurement Act apply. These include convictions for organised crime, corruption, fraud, terrorist offences or related offences, offences related to illegal employment of foreigners or paying less than the statutory wage, child labour or human trafficking, tax or social security debts, and situations where awarding the contract would breach an international or Government of the Republic sanction. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or another similar register in its country of establishment, if required by the laws of that country. For bidders established in Estonia, the contracting authority checks the data itself; foreign bidders must submit a valid copy of the registration certificate.
The bidder and/or its subcontractor must have performed at least one or more contracts similar to the subject of the procurement within the last 60 months before the start of the procurement, related to the design and installation of fire alarm systems, with a total value of at least EUR 100,000. A list of the most important contracts must be submitted, including their value, dates and the other contracting parties.
The bidder and/or its subcontractor must have qualified responsible persons for the works: a security systems designer with professional certificate level 6 and competence in fire alarm system design or equivalent; a security systems technician with professional certificate level 4 and competence in fire alarm system installation and maintenance or equivalent, and if applicable a Honeywell Esser FlexES installation and commissioning competence certificate or equivalent; a responsible security systems specialist with professional certificate level 5 and competence in fire alarm system installation and maintenance or equivalent; and a person managing electrical works with at least an A-class competence certificate or equivalent. A foreign bidder must submit copies of the documents issued in its country of establishment and a confirmation that within one month after signing the contract it will submit the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the above-mentioned responsible person’s qualification and competence.
The bid must be submitted according to the required structure, and the calculation form, documents confirming the technical characteristics of the offered equipment and materials, and, where necessary, materials proving equivalence must be attached. Conditional bids are not allowed.
