Compliance requirements

The bidder must not have the exclusion grounds listed in the Estonian Public Procurement Act § 95(1) items 1–5 and § 95(4) item 12. The bidder must confirm the absence of those grounds in the public procurement register. If the bidder, a joint bidder or a relied-on subcontractor is a foreign undertaking, documents proving the absence of the exclusion grounds must be added, including documents concerning the company itself and its management, governing or supervisory body members, procurists or other persons entitled to represent or control the company or make decisions on its behalf. If the bidder is a branch of a foreign company, proof of the foreign company’s absence of exclusion grounds must also be submitted. If there are other persons in the bidder’s company who may represent, decide for or control the company and who are not visible from the business register card, the bidder must provide their name and personal identification code, or confirm that no such persons exist.

Qualification criteria and exclusion grounds

The bidder must provide turnover data for the last three completed financial years. The total turnover for those three years must be at least EUR 2,000,000. If the financial year is not the calendar year, the data must be provided for the relevant financial-year periods. If the contracting authority cannot verify the data from public registers, it may request the last three annual reports or extracts from them. If the bidder relies on another undertaking’s resources, a consent form from that undertaking must be submitted stating the amount of turnover on which the bidder may rely, confirming that financial resources will be provided for contract performance if needed, and confirming joint liability for proper performance of the contract. In the case of joint bidders, the financial and economic standing must be demonstrated with the required data for each relevant participant.
