Compliance requirements
The machine-readable notice included standard exclusion grounds based on final convictions, including participation in a criminal organisation, corruption, fraud and other legally listed grounds. The bidder or its management, administrative or supervisory body members, or authorised representatives may be excluded if they have been convicted within the last five years, or if the exclusion period in the judgment is still in force. Where applicable, the bidder may provide evidence of self-cleaning. The notice also refers to the possibility of checking whether the information is electronically available.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification, suitability or compliance criteria; these must be checked in the tender documents. According to the compliance conditions, the bidder must submit the tender in the required structure, complete every line of the technical specification and compliance form, and attach the manufacturer’s specifications so that compliance of the track tractor can be verified. The minimum warranty period for the offered track tractor is 24 months; any longer warranty period must be stated in months and is used as an award criterion. The tender may not be conditional. If the tender contains trade secrets, they must be justified. The bidder must also confirm that the tender complies with the procurement documents, that equivalence has been explained where necessary, and that the offered goods are not subject to international sanctions.
