Compliance requirements

The bidder must be excluded if the bidder, or a member of its administrative, management or supervisory body, a procurator or another authorised representative, has been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering, financing of terrorism, enabling illegal employment, violating the conditions for employing a foreign national, illegal use of child labour, or trafficking in human beings. Exclusion also applies if the bidder has tax, duty or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment. The bidder is also excluded if concluding the contract would breach an international sanction or a sanction of the Government of the Republic. Only bidders established in Estonia, another EU Member State, another EEA contracting state, or a country that has acceded to the WTO Government Procurement Agreement may participate. An undertaking established in the Russian Federation or the Republic of Belarus may not participate.

Qualification criteria and exclusion grounds

The bidder must be entered in the commercial register of its country of establishment if this is required by that country’s law. If registration is mandatory, evidence of registration must be submitted. A bidder established in Estonia does not need to submit a register extract. The bidder must have the technical capability to supply the goods described in the tender. If the bidder is not the manufacturer, it must submit the manufacturer’s original authorisation letter or a notarised copy authorising marketing of the goods in Estonia.
