Compliance requirements

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurators or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences linked to terrorist activity, money laundering or terrorist financing, or child labour and other forms of human trafficking, where the relevant exclusion ground applies. If such a ground exists, the bidder may provide a description of self-cleaning measures where permitted. The exact exclusion grounds and any possible evidence must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder’s net turnover for each of the last three completed financial years before the start of the procurement must be at least EUR 200,000 excluding VAT. The bidder must state these turnovers in the ESPD. Within the 36 months before the start of the procurement, the bidder must have completed at least one similar software development or implementation contract worth at least EUR 100,000 excluding VAT. Similar software means software that includes a user environment for the contracting authority and the contracting authority’s client, is integrated with a state or local government register, is integrated with the contracting authority’s accounting software, and allows login at least via ID card, Mobile-ID and Smart-ID. The ESPD must include the contract details, including the description of the subject matter, information needed to assess similarity, performance period, contract value, the client’s name and contact details, and, in the case of a public procurement, the reference number.
