Compliance requirements

The bidder and its management or supervisory body members, procurators, and other authorised representatives must not have been finally convicted within the last 5 years of participation in a criminal organisation, corruption, or fraud. If such a ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must confirm that it will not involve subcontractors or suppliers accounting for more than 10% of the contract value who are citizens, residents, or undertakings established in the Russian Federation, or persons or entities connected to them as described in the applicable sanctions rules. The bidder must confirm that it will not involve a subcontractor in contract performance that would have to be replaced under Section 122(7) of the Public Procurement Act. It must also confirm that no information marked as trade secret is disclosed in a prohibited form.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register of its country of establishment or in an equivalent register. The contracting authority may request evidence of registration. The bidder’s total annual turnover in the last completed financial year within the last three years before the start of the procurement must be at least EUR 50,000. The bidder must have prepared at least 2 detailed spatial plans during the 36 months preceding the start of the procurement. The plans must have been accepted by the client, but they do not have to be adopted. Acceptable proof includes a local authority act, a publicly available reference, or, for an unadopted plan, the client’s confirmation of acceptance. The bidder’s responsible person, i.e. the planner, must meet the requirements of Section 6(10) of the Spatial Planning Act: they must have higher education corresponding to a master’s degree in geography, architecture or landscape architecture, or a professional certificate at the level of a responsible specialist, or the profession of spatial environment planner. In addition, they must hold a level 7 spatial environment planner qualification. Qualification documents must be submitted if requested. The bid must comply with the procurement documents, and conditional bids are not permitted. If the bidder relies on equivalence, it must explain this and provide evidence where necessary.
