Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1)(1)–(5) of the Estonian Public Procurement Act apply: criminal convictions of the bidder or certain representatives for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or financing terrorism; convictions for enabling illegal work for a foreign national staying without a legal basis or for violating conditions of employment of a foreign national in Estonia, including paying less than the statutory wage; convictions for illegal use of child labour or human trafficking; tax, fee or environmental charge arrears under Estonian law or tax/social security contribution arrears under the law of the bidder’s country of establishment; or a situation where entering into the contract would breach an international sanction or a Government of Estonia sanction. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment if this is required by that country’s law. An Estonian bidder does not need to submit a register extract. The bidder and/or its subcontractor must have completed at least one contract in the last 60 months for installation and/or repair of refractory lining and/or masonry on a high-temperature industrial unit. The reference contract must cover at least 150 m² on one unit, an operating temperature of at least 900 °C, an abrasive working environment, and installation or repair of multilayer refractory lining or masonry. Experience on CFB boilers or comparable units, as well as on solid-fuel or pulverised-fuel boilers and their cyclones, is also acceptable. The bidder must submit a list of the main contracts completed in the last 60 months on the form “List of construction works”, including the scope of the contracts, the year of conclusion, and the names of clients with telephone numbers and email addresses. If the bidder relies on the resources of another company or a joint bidder, it must also provide the details of that entity and, if requested, its consent and confirmation of direct participation. The tender must include the supervisor’s CV, documents proving the supervisor’s technical competence, and the CV and competence documents of the refractory lining specialist. The supervisor must have technical competence in refractory lining or masonry installation and repair and must have participated in at least one project of comparable complexity on high-temperature industrial equipment. The refractory lining specialist must hold a valid API 936 certificate or another equivalent proof or training and must also have experience on comparable works. For both roles, the bidder must submit a CV, supporting evidence, and the person’s written consent to be named and to have their personal data processed. The bidder must also provide a description of the technical solution, a list of materials, and technical data sheets for the materials. If the machine-readable notice did not set out some form or attachment requirements in full, they must be checked in the tender documents.
