Compliance requirements

The contracting authority checks the exclusion grounds under Section 95(1) of the Public Procurement Act for the successful tenderer before signing the contract and may require supporting documents if the data are not freely available from public registers. The tenderer must confirm that none of the exclusion grounds apply, including no direct or indirect involvement in preparing the procurement, no conflict of interest, no serious or repeated breach of previous public contracts, and no insolvency or liquidation proceedings. There is also a national-law-based restriction on participation by country of establishment or residence, if the tender documents impose such a restriction.

Qualification criteria and exclusion grounds

To deliver the service properly, the contractor must involve a team that meets the minimum requirements: for each group there must be two trainers, one with experience in child protection or the social sector and the other with experience in adoption, guardianship or foster care. Both trainers must have completed the PRIDE pre-training for trainers in 2017 or 2021, or alternatively must have delivered that PRIDE pre-training themselves in 2017. In addition, each trainer must have delivered at least one further training for adults within the last 5 years, with a duration of at least 8 academic hours. The tenderer must submit a team description and sufficiently detailed information on each trainer’s experience and training history so that the contracting authority can assess compliance unambiguously.
