Compliance requirements

The contracting authority will exclude a bidder or joint bidder if the bidder, or a member of its administrative, management or supervisory body, or another legal representative connected with the procurement, has been convicted of participation in a criminal organisation, breach of integrity duties, corruption, fraud, a terrorist offence or related incitement, aiding or attempt, money laundering or terrorist financing. The bidder may also be excluded if one or more grounds under Section 95(4) of the Public Procurement Act apply. The contracting authority will also exclude a bidder or each joint bidder if it has tax, fee or environmental charge arrears under Estonian law, or tax or social security contribution arrears under the law of its country of establishment. For bidders registered in Estonia, the contracting authority checks the absence of tax debt itself. A foreign bidder must provide, on request, a certificate from the competent authority of its country of establishment if the contracting authority cannot verify the data from public registers.

Qualification criteria and exclusion grounds

The bidder must have at least 3 years of experience in selling and maintaining cars as of the date the contract notice is published. A compliant confirmation and a list of the most important sales contracts or orders completed during the last 3 years must be submitted. The bidder must ensure maintenance, servicing and repair of the offered vehicles in Pärnu city. The work must be carried out by a company officially authorised by the vehicle manufacturer, and the bid must state the service location address and the name of the company performing the maintenance. The bid must comply with the technical specification in the procurement documents. The bidder must submit a correctly completed compliance table and the make, model, technical parameters and full list of equipment of the offered vehicle in sufficient detail for the contracting authority to assess compliance. If an equivalent solution is offered, the bidder must explain the equivalence and attach evidence of equivalence. In the case of a joint bid, an authorised representative must be appointed and a joint bidder power of attorney must be attached.
