Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under § 95(1) points 1–5 of the Public Procurement Act apply. These include convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; convictions for enabling illegal employment of foreigners or violating the conditions for employing foreigners in Estonia, including paying less than the statutory wage rate; convictions for illegal use of child labour or human trafficking; tax, environmental charge or social security contribution debts; or a situation where awarding the contract would breach an international sanction or a sanction of the Government of the Republic. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must have completed at least one similar contract related to the repair of similar equipment within the last 36 months before the start of the procurement procedure. A list of the most important contracts must be submitted, including their value, dates and the other contracting parties. If the bidder relies on a subcontractor’s experience, the subcontractor must also be entered in the subcontractor table so that the contracting authority can check exclusion grounds.
The bidder and/or its subcontractor must have qualified responsible persons for carrying out the work. Required personnel include a welder with certification according to EVS-EN ISO 9606-1:2013 or equivalent; at least 5 workers with certificate 111 T FW FM1 ml; at least 5 workers with certificate 111 T FW FM3 ml. In addition, locksmiths are required: at least 10 workers with hot-work permits and a valid hot-work training certificate; at least 6 locksmith-riggers with a valid rigging training certificate; or at least 14 workers with both hot-work and rigging permits and the relevant certificates. If subcontracting is used, the subcontractor’s consent to perform subcontracted work must be provided.
The bidder must submit a list of the responsible persons for the work and copies of documents proving their qualifications and competence. A foreign bidder or its foreign subcontractor that does not have the relevant documents issued in Estonia must confirm that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the qualification and competence of the responsible person.
