Compliance requirements

The bidder must confirm that neither it nor the members of its management, representation or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking. If any such ground applies, evidence of self-cleaning measures may need to be provided. The ESPD also requires an answer on whether this information is electronically available.

Qualification criteria and exclusion grounds

Within the 60 months preceding the start of the procurement, the bidder must have properly performed at least 1 public road construction contract covering at least 800 m2 of hard-surfaced road works. In the ESPD, the bidder must provide a short description of that contract, including the road area built, location, contract performance period and the client’s contact details; upon request by the contracting authority, evidence of proper performance must be provided. In addition, the bidder’s team must include at least the persons with the required education and professional qualifications, but the machine-readable notice did not set out all exact roles in full; these must be checked in the ESPD and tender documents. The bid must comply with the tender documents, conditional bids are not allowed, and the bidder must confirm a 24-month warranty for all works and installed equipment as well as a performance security for warranty obligations in the amount of 5% of the total contract value. If the bid is joint, a joint-bidders power of attorney must be attached. The bid price must be submitted in the required structure and the bid price table must be included.
