Compliance requirements

The contracting authority will not award the contract to a bidder who is subject to the exclusion grounds set out in Section 95(1)(1)–(5) of the Public Procurement Act. The contracting authority may also exclude a bidder if one of the grounds referred to in Section 95(4)(8) or 95(4)(12) applies. The bidder must confirm in the public procurement register that these exclusion grounds do not apply. It must also be checked whether the bidder is restricted by the contracting authority from submitting a tender or request to participate based on its country of establishment or residence.

Qualification criteria and exclusion grounds

The hankepass did not contain any qualification or selection criteria. The machine-readable notice did not include precise qualification, suitability or compliance requirements; these must be checked in the tender documents. However, the compliance requirements include several practical obligations: the tender must comply with all tender documents, conditional tenders are not allowed, Form II price form must be submitted, the bidder must confirm compliance with the ‘Workwear descriptions’, provide an Estonian-language description with a picture and size chart, confirm that the products are new and defect-free, and submit samples within 7 working days after the tender deadline. Personal protective equipment must be CE-marked; the reflective strips on jackets, softshell jackets and all high-visibility products must comply with EN ISO 20471:2013 at least Class II; and the fabric of the clothing must comply with EN ISO 13688:2013 (less than 3% shrinkage after 5 wash cycles).
