Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal employment of foreign workers, illegal use of child labour, human trafficking, and tax, fee or environmental charge arrears or equivalent arrears in the bidder’s country of establishment. The bidder must also confirm that none of the voluntary exclusion grounds apply, such as a material breach of a previous public contract or the submission of false information about qualification. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus, and the materials, equipment and goods used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
Within the 60 months before the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts with the performance period, the other contracting party’s details (including the client representative’s contact details, phone number and email address), and, in public procurement cases, the reference numbers. On request, the bidder must provide evidence that the similar electrical construction contracts were properly performed. The tender must comply with the procurement documents and include a price table with all unit price fields completed. The team must include a person with valid switching authorisations, entered in Elektrilevi’s partner portal before the deadline for submitting tenders; for low-voltage works, at least low-voltage switching authorisations are required, and in other cases both low-voltage and medium-voltage switching authorisations are required. There must also be a person appointed as responsible for the work operation, entered in Elektrilevi’s partner portal before the deadline. The team must additionally include a lead electrical worker with valid A-level competence or, under the Vocational Education Act, at least level 6 qualification, who has the relevant certificate at the time of submission and is entered in the partner portal before the deadline. The bidder must provide the names and contact details of the signatory(ies) and the contact person, and a power of attorney if needed. If the bidder joins the contracting authority’s factoring programme, the payment term is 95 calendar days; otherwise the standard payment terms are 14, 35 or 45 calendar days depending on the contract value.
