Compliance requirements
The bidder must confirm that neither it nor its management, representation or supervisory body members have been finally convicted in the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking. If such a ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. For subcontractors, there is also a requirement that no subcontractor used in contract performance may be one that would have to be replaced under Section 122(7) of the Estonian Public Procurement Act. In addition, a sanctions requirement applies: subcontractors and suppliers accounting for more than 10% of the contract value must not be linked to a citizen, resident or company established in the Russian Federation, nor be owned or controlled by such a person or entity, or act on their instructions.
Qualification criteria and exclusion grounds
The bidder must involve a responsible person for the construction works who holds at least a level 7 certified HVAC engineer qualification or a level 7 thermal energy engineer qualification. If the certificate was issued in Estonia, the contracting authority will verify it in the public professional register and no separate certificate needs to be submitted. If the certificate or other proof of qualification was issued outside Estonia, the bidder must submit a copy of that document and a document issued by the competent Estonian authority confirming that the foreign qualification corresponds to the required qualification. The bid must be submitted on the required form, ‘Annex 4 Bid Price Form’, and the bid price must be provided in the prescribed structure. The bidder must confirm that the bid complies with the tender documents. If a joint bid is used, a power of attorney from the joint bidders must be attached. If the bidder relies on another entity’s resources, that entity’s consent must be attached. If subcontracting is used, the subcontracting form and subcontractor details must be submitted. A site visit is possible by prior arrangement, and a document confirming the visit may be attached if applicable. If the bidder treats information as a trade secret, it must be briefly described and justified, but the bid price and other price-related numerical indicators may not be marked as trade secrets. The machine-readable notice did not include precise other qualification or compliance requirements; these must be checked in the tender documents.
