Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The tender documents also include confirmations regarding joint bids, trade secrets, equivalence, sanctions, and restrictions on sanctioned goods and on subcontractors/suppliers.
Qualification criteria and exclusion grounds
The bidder must have sold each product offered in this tender under at least one contract during the last 3 years. To prove this, the bidder must submit a list of properly performed sales contracts or transactions showing which part and which product was sold, together with the contract dates, value and information about the other parties. The bidder’s company must have a product representative who has been trained by the manufacturer or has completed training for the products covered by the tender; upon the contracting authority’s request, copies of certificates proving the training or a written confirmation from the manufacturer must be provided. The bidder must have the right to represent and sell the offered products in Estonia and must provide a document or copy from the manufacturer or the manufacturer’s authorised representative proving this. The bid must comply with the technical specifications in Annex 1, and the bidder must submit the completed Annex 1, the declaration in Annex 3 form II, a power of attorney and joint liability confirmation for a joint bid, the technical description and the price form in the required structure.
