Compliance requirements
A bidder must be excluded if any of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply to the bidder or to persons with representation rights: participation in a criminal organisation, corruption, fraud, terrorism-related offences or money laundering, illegal employment of foreign workers, offences involving child labour or trafficking in human beings, tax debts, or a breach of sanctions. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must submit at least one reference contract that was properly performed within the 60 months before the start of the procurement and that is similar in complexity and volume to the subject of the tender, for construction or repair works. A list of contracts must be provided, including their value, dates and the other contracting parties, using the form ‘List of contracts’. The bidder and/or its subcontractor must have a qualified person responsible for carrying out the works, with at least level 6 construction engineer professional qualification (excluding initial qualification) and competence in managing construction activities. Copies of documents proving that person’s qualification and competence must be submitted. The bid must comply with the tender documents; conditional bids are not allowed. Where the contracting authority refers to a standard, technical approval, trademark or similar basis, equivalence must be explained where necessary and evidence of equivalence must be attached. If the offered goods are subject to international sanctions or originate from a sanctioned area, the bid is not acceptable.
