Compliance requirements

Mandatory exclusion grounds: the bidder and its management, supervisory or authorised representatives must not have been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; there must also be no convictions related to enabling illegal employment, child labour or human trafficking. The bidder must not have tax, duty or environmental charge arrears, or tax/social security contribution arrears under the law of its country of establishment. Neither the bidder nor a member of its management body may be subject to an international sanction where concluding the contract would breach that sanction. The bidder must confirm that none of these grounds apply. Voluntary exclusion grounds: the contracting authority may exclude a bidder if it has breached environmental, social or labour law obligations, is bankrupt or in liquidation, has seriously breached professional rules, has entered into anti-competitive agreements, has an unavoidable conflict of interest, has involved in the tender preparation a person who also took part in preparing the procurement, has previously seriously breached a contract, has submitted false information or failed to provide required documents, has tried to influence the contracting authority or gain an unfair advantage, has been convicted of tax offences, or is not entitled to submit a tender. The bidder must also confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

The bidder’s net turnover for each of the last three completed financial years must be at least EUR 400,000. If the financial year does not coincide with the calendar year, the requirement applies to the last three completed financial years, and at least six months must have passed since the end of the latest completed financial year by the tender submission date. Proof must be provided by an extract from the last three annual accounts showing the net turnover; for a legal entity registered in Estonia, this does not apply if the data are publicly available to the contracting authority from a register. During the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for similar electrical construction works, at least one of which must have had a value of at least EUR 80,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting party’s contact details and, in public procurement cases, the reference numbers; the contracting authority may request evidence of proper performance. The tender must comply with the procurement documents and include the required price table with all unit price fields completed. For switching operations in the 0.22–20 kV electricity network, the bidder must have, before the opening of tenders, an employee with valid switching rights entered in the EPP environment; for low-voltage works, at least low-voltage switching rights are sufficient, and in other cases both low-voltage and medium-voltage switching rights are required. The bidder must also have a person designated as responsible for the work operation, entered in the EPP environment before the opening of tenders. The person leading electrical works must have valid A-competence or at least level 6 vocational qualification and must be added to the EPP environment before the opening of tenders. The bidder must name the contract signatory and the contact person for contract performance, with contact details; if the right of representation does not arise from the articles of association, a power of attorney must be included. If the bidder does not join the contracting authority’s factoring programme, the standard payment term applies: 14 days for contracts up to EUR 59,999, 35 days for EUR 60,000–249,999, and 45 days for contracts of EUR 250,000 or more; if the factoring programme is used, the payment term is 95 days. The bidder must also confirm that the materials, equipment and goods, including components, used in the works are not produced in or originating from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin.
