Compliance requirements
The bidder must confirm that neither it nor its management board members, persons with representation rights, or controlling persons have been finally convicted within the last five years for exclusion grounds such as participation in a criminal organisation, corruption, fraud and other offences listed in the ESPD. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where permitted. For subcontractors, the sanctions- and exclusion-related requirements must also be met if they are used in contract performance.
Qualification criteria and exclusion grounds
The bidder’s average net turnover in the field related to the concession contract over the last three completed financial years must be at least EUR 1,000,000 per year. If the company has operated for less than three years, the arithmetic average net turnover over its operating period must also be at least EUR 1,000,000 per year. Joint bidders may aggregate turnover figures. The bidder must provide a declaration and, if requested, evidence of turnover.
Within the last 60 months before the start of the procurement, the bidder must have properly and in accordance with good construction practice completed at least one construction contract similar to the subject of the procurement. A similar contract is one in which the bidder acted as the main contractor for road, green area and related infrastructure construction works. The contracting authority may require a reference letter from the client of the reference contract.
The tender must include the required powers of attorney if the person signing the tender is not a person with representation rights entered in the register, and in the case of a joint tender, the joint bidders’ power of attorney. If necessary, a consent from another entity must also be submitted for economic and financial standing and for technical and professional capacity. The tender must comply with the compliance requirements, and the bidder must confirm that subcontractors or suppliers from the Russian Federation, or entities linked to them, are not engaged for more than 10% of the contract value.
