The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activities, money laundering or terrorist financing, or any other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The exact exclusion grounds and any remediation conditions must be checked in the ESPD and tender documents.

The bidder must be registered in the commercial register or an equivalent register in its country of establishment. In the fertilizer supply sector, the bidder must show annual turnover of at least EUR 22,000 in each of the last three completed financial years; the ESPD also states a minimum requirement of EUR 20,000. In addition, the bidder must have at least 3 completed fertilizer supply contracts in the 36 months before the start of the procurement and must submit the value, dates and other contracting parties for those contracts with the tender. The tender must comply with the tender documents, be unconditional, and any equivalence explanations and evidence must be attached where needed.
