Compliance requirements

The contracting authority will exclude a bidder if any of the exclusion grounds set out in Section 95(1)(1)–(5) of the Public Procurement Act apply. The bidder must confirm that none of those grounds exist. In addition, the bidder must confirm that it does not breach any residence- or establishment-based restriction on submitting a tender or request to participate, if such a restriction is set out in the procurement documents.

Qualification criteria and exclusion grounds

The bidder’s net turnover for each of the last completed financial years ending before the start of the procurement over the last three years must be at least EUR 200,000. A foreign bidder must provide a certificate from the competent authority in its country of establishment or an extract showing the net turnover for the last three years; if the latest completed financial year is not yet publicly available, an extract from the report must be provided. Within the 36 months before publication of the simplified procurement, the bidder must have performed at least 1 sales contract for specialty oils, lubricants and liquids with a total value of at least EUR 70,000 excluding VAT. The bidder must provide the contract dates for conclusion and performance, and the other party’s name, email address, telephone number and contract value. The tender must be submitted in the structure set out in the procurement documents, and a completed sample shopping basket must be attached. The bidder must have a sales office and/or warehouse within a maximum radius of 50 km from the contracting authority’s location at Väike-Sõjamäe 2, Tallinn, so that the contracting authority can collect goods on site if needed. The bidder must appoint a person responsible for performing the framework agreement, who will act as the bidder’s contact person and manager for the framework agreement and whose Estonian language skills are at least at B2 level; the contact person’s name and contact details must be provided before the framework agreement is signed or when they change. The bidder must confirm that the tender complies with the requirements in the procurement documents, that conditional tenders are not allowed, and that use of an online ordering system must not create additional costs for the contracting authority. The bidder must also confirm compliance with equivalence requirements and, where necessary, attach evidence of equivalence. If the tender contains business secrets, they must be briefly described and justified; the tender price and unit prices may not be marked as business secrets.
