Compliance requirements

The tender documents include the standard exclusion grounds, especially convictions for participation in a criminal organisation, corruption, fraud and other mandatory grounds under the Public Procurement Act. If an exclusion ground applies, the bidder may have to provide evidence of self-cleaning, and the contracting authority may request supporting documents. Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register of its country of establishment if required by that country's law. An Estonian bidder does not need to submit a commercial register certificate unless requested by the contracting authority. For contract performance, the bidder must involve a work supervisor with at least level 4 railway track mechanic qualification or an equivalent qualification, and an excavator operator who is authorised to work with the excavator named in the bid, has a railway locomotive driver qualification or equivalent, and has a work permit for movement on the track area by 01/11/2026 at the latest. The same person may act as both work supervisor and excavator operator if both sets of requirements are met. If a team member is not the bidder's employee, the bidder must also submit that person's ESPD and, if requested, a confirmation of willingness to participate. Foreign professional certificates must, where required, have undergone the TTJA verification or recognition procedure, or an application for recognition must have been submitted. The bid must comply with all tender document requirements and conditional bids are not allowed. If an equivalent solution is offered, equivalence must be explained and evidence attached. The bid price must be submitted in euros in the structure required by the RHR and the participation application must be submitted on the form in Annex 2.
