Compliance requirements

The tender documents include the standard exclusion grounds, including convictions for participation in a criminal organisation, corruption, fraud and terrorist offences. If such a ground applies, the bidder may, where allowed, provide evidence of self-cleaning measures. The notice also requires confirmation that the contract award would not breach international sanctions or Government of Estonia sanctions, and the bidder may have to submit supporting documents on request.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register of an EU, EEA or WTO GPA member state, if required by the laws of the bidder’s country of establishment. On request, a copy of a valid registration certificate must be submitted; an Estonian bidder does not need to submit it if the data are publicly available to the contracting authority. The bidder’s net turnover in railway maintenance and/or repair work must have been at least EUR 100,000 per year, excluding VAT, in each of the last three completed financial years before the start of the procurement. If the financial year is not 1 January to 31 December, the bidder must provide data for the relevant financial-year periods. If the bidder relies on another company’s resources, the bidder must also provide the required information about that company and, on request, that company’s consent. For contract performance, the bidder must involve a work supervisor with at least level 4 railway track mechanic qualification or an equivalent qualification, and a special rolling-stock driver. Any further requirements for these roles and any additional evidence must be checked in the tender documents.
