Compliance requirements

Qualification criteria and exclusion grounds

The bidder must provide the qualification data and documents required in the ESPD and tender documents. As a financial capacity requirement, the bidder’s net turnover in the construction works sector for each of the last three completed financial years before the start of the relevant procurement must be at least EUR 20,000,000. If the information is not available from a public database, the contracting authority may require the last three annual reports or extracts. The bidder must also confirm that, before signing the property right agreement for the building rights, it will at its own expense conclude construction all-risk insurance (CAR) and construction liability insurance and submit a copy of the policy; the property damage cover must be at least equal to the concession contract price and the personal injury/property damage cover at least 10% of the total concession contract value including VAT. The bid guarantee must be EUR 50,000 and must be evidenced by a bank, financial institution or insurer guarantee or by depositing the amount into the contracting authority’s account. The bid must be unconditional and submitted in the structure required by the tender documents. In a joint bid, an authorised representative must be appointed and a joint-bidders power of attorney must be attached. The tender documents also require that the bidder does not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act, and that subcontractors or suppliers representing more than 10% of the contract value are not Russian citizens, residents, or entities established in the Russian Federation, or persons controlled by them.
